Approved Motion: That the motion 鈥淭hat the Board of Education of School District No.61 (Greater Victoria) direct the Superintendent: 1. To propose amendments to Policy 110 (Equity), Policy 5147 (Inclusion of Students with Special Needs) and any other relevant policy to ensure that each state that the educational opportunities, student experiences and student supports across schools and programs of choice will not be substantially different, as demonstrated by both key performance indicators and the direct experiences of those within schools, including students, parents, teachers and support staff; and 2. To establish a Working Committee prior to the end of November 2024 of Rightsholders and educational partners, pursuant to Policy 9210 (The Development of Policy), with the mandate to review and make recommendations regarding the proposed amendments, which will be then forwarded to the Education Policy and Directions Committee on December 2, 2024; and 3. To report to the Working Committee and the Education Policy and Directions Committee on December 2, 2024 via a written report, which relevant data are currently tracked within the school district's systems, and which data should be tracked with policy and/or regulation changes by the Board of Education of School District No. 61; and 4. To work with School District Rightsholders and educational partners to draft and bring forward amendments to the Equity Ad Hoc Committee Terms of Reference to ensure the successful implementation of School District No. 61 policies as they relate to equity and inclusion; AND FURTHER That the Board continues to advocate to the Province for additional resources and supports to ensure the successful implementation of the Equity and Inclusion Policies.鈥� be added to the agenda under New Business.

Approved Motion: That the Board of Education of School District No. 61 (Greater Victoria) approve Capital bylaw No. 2022/23-CPSD61-01 Capital Plan 2022/23. WHEREAS in accordance with Section 142 of the School Act, the Board of Education of School District No. 61 (Greater Victoria) (hereinafter called the 鈥淏oard鈥�) has submitted a capital plan to the Minister of Education (hereinafter called the "Minister") and the Minister has approved the capital plan or has approved a capital plan with modifications, NOW THEREFORE in accordance with section 143 of the School Act, the Board has prepared this Capital Bylaw and agrees to do the following: (a) Authorize the Secretary-Treasurer to execute a capital project funding agreement(s) related to the capital project(s) contemplated by the capital plan or the capital plan with modifications; (b) Upon ministerial approval to proceed, commence the capital project(s) and proceed diligently and use its best efforts to complete each capital project substantially as directed by the Minister; (c) Observe and comply with any order, regulation, or policy of the Minister as may be applicable to the Board or the capital project(s); and, (d) Maintain proper books of account, and other information and documents with respect to the affairs of the capital project(s), as may be prescribed by the Minister. NOW THEREFORE the Board enacts as follows: 1. The Capital Bylaw of the Board for the 2022/23 Capital Plan as approved by the Minister, to include the supported capital project(s) specified in the letter addressed to the Secretary-Treasurer and Superintendent, dated March 15, 2022 is hereby adopted. 2. This Capital Bylaw may be cited as School District No. 61 (Greater Victoria) Capital Bylaw No.2022-23-CPSD61-01. Read a first time the 25th day of April, 2022; Read a second time the 25th day of April, 2022;

Approved Motion: Whereas a board of education may dispose of land or improvements owned or administered by the board under the authority of Section 96(3) of the School Act, subject to the Orders of the Minister of Education (the 鈥淢inister鈥�); AND WHEREAS the Minister issued Order M193/08 effective September 3, 2008 (the 鈥淥rder鈥�) requiring fee simple sales and leases of land or improvements for a term of ten years or more to be specifically approved by the Minister, unless the transferee is an independent school or another school board; AND WHEREAS Section 65(5) of the School Act requires a board of education to exercise a power with respect to the acquisition or disposal of property only by bylaw; AND WHEREAS: A. The Board of Education of School District No. 61 (Greater Victoria) (the 鈥淏oard鈥�) owns lands and improvements at 2780 Richmond Road, Victoria, B.C. known as Lansdowne Middle School, South Campus (formerly Richmond Elementary School site (the 鈥淧roperty鈥�); B. The Facility Number of the Property is:105629. C. The legal description of the Property is: Parcel Identifier: 005-170-222 Lot 3, Section 26, Victoria District, Plan 10792; D. The Board proposes to subdivide and sell to the Victoria Hospice Society (the 鈥淰HS鈥�) the portion of the Property lying to the west and south of Bowker Creek and measuring approximately 1.9 acres in area as shown on Schedule A attached hereto (the 鈥淟ands鈥�), pursuant to the terms of a conditional agreement of purchase and sale (the 鈥淪ale Agreement鈥�) for a price of $2,500,000, adjusted as provided in the Sale Agreement (the 鈥淧rice鈥�); E. The Board is satisfied that it would be in the best interests of the Board to enter into the Sale Agreement and pursuant to its obligations thereunder subdivide the Property and sell the Lands to the VHS for the Price (the 鈥淪ubdivision and Sale鈥�); F. Approved Motion: WHEREAS section 65 (5) of the School Act provides that a board of education may exercise a power with respect to the acquisition or disposal of property owned or administered by the board only by bylaw; AND WHEREAS pursuant to Section 96 (1) of the School Act, "land" includes any interest in land, including any right, title or estate in it of any tenure; AND WHEREAS section 96 (3) of the School Act provides that a board of education may dispose of land or improvements, or both, subject to the orders of the British Columbia Minister of Education (the 鈥淢inister鈥�); AND WHEREAS section 3 of the Disposal of Land or Improvements Order M193/08 (the 鈥淥rder鈥�) provides that boards must not dispose of land or improvements by sale and transfer in fee simple or by way of lease of 10 years or more unless such disposal is to another board or an independent school for educational purposes or is approved by the Minister in accordance with section 5 of the Order; AND WHEREAS section 5 of the Order provides that the Minister may approve, with any terms and conditions, a disposition of land or improvements; AND WHEREAS: (a) The property described in this Bylaw (the 鈥淧roperty鈥�) is registered in the name of The Corporation of the City of Victoria (the 鈥淐ity鈥�) but is being used and administered by The Board of Education of School District No.61 (Greater Victoria) (the 鈥淏oard) for school purposes; (b) The Board is operating SJ Burnside Alternative School on a portion of the Property and has determined that the remainder of the Property, shown outlined in bold on Schedule A attached to this Bylaw (the 鈥淨uit Claim Area鈥�), is no longer required for school purposes; (c) The Board has agreed to release to the City all of its interest in the Quit Claim Area by way of a Quit Claim Deed in favour of the City (the 鈥淨uit Claim Deed鈥�) in exchange for consideration to be provided to the Board as described in an agreement (the 鈥淔ramework Agreement鈥�) among the City, the Board, Pacifica Housing Advisory Association and British Columbia Housing Management Association, which will be fully executed as a precondition to the disposition of the Quit Claim Area as contemplated by this Bylaw; (d) The Property is legally described as: PID: 030-095-859 - Lot 1, Section 4, Victoria District, Plan EPP70074; (e) The Board has confirmed that the Quit Claim Area will not be required for future educational purposes; and (f) The Board is satisfied that the consideration to be provided to the Board under the Framework Agreement represents the fair market value of the Quit Claim Area; NOW THEREFORE be it enacted as a Bylaw, that: 1. Subject to the approval of the Minister, the Board hereby authorizes the execution and delivery of the Quit Claim Deed in favour of the City on the terms and subject to the conditions in the Framework Agreement; and 鈥� 2. Subject to the approval of the Minister, the Board hereby approves, ratifies and confirms the terms, covenants and conditions of the Framework Agreement and authorizes the Secretary-Treasurer of the Board, for and on behalf of the Board, to execute and deliver the Quit Claim Deed in the form provided as an attachment to the Framework Agreement, and all other documents required to complete the transactions contemplated in the Framework Agreement, with such amendments as the Secretary-Treasurer may consider reasonable and in the best interests of the Board. This bylaw may be cited as "School District No. 61 (Greater Victoria) SJ Burnside Alternative School Site Disposal Bylaw, 2021". Read a first time the 25th day of October, 2021 Read a second time the 25th day of October, 2021 Read a third time this 13th day of December, 2021 and passed and adopted the 13thday of December, 2021.

Action: The Board voted in favour of the 3rd and final reading of the SJ Burnside Alternative School Site Disposal Bylaw, 2021 and the Ministry of Education was notified.
